City of Cork Vocational Education Committee

 

Literacy Organiser Contract

 

The post is a fixed purpose temporary part-time appointment with City of Cork Vocational Education Committee on the following terms:

 

POST

 

Literacy Organisers with Name of Literacy Scheme.

 

DUTIES

 

You will carry out such duties as are assigned to you from time to time by the Representative Group for the Scheme.  The attached job description provides an outline of the duties involved (Appendix).

 

TERM OF APPOINTMENT

 

Your appointment dates from Start Date and will continue until End Date unless previously terminated by one month’s notice in writing on either side and subject to the availability and continuation of funding.

 

TERMINATION/DISMISSAL

 

Notwithstanding the fact that this is a fixed purpose contract, the Vocational Education Committee reserves the right to terminate your employment prior to the expiry of the fixed term.  The Unfair Dismissals Act, 1977, will not apply to such termination.

 

Termination in such situations can be for any of the following reasons: -

 

(a)          Incompetence or poor work performance

(b)          Misconduct (serious or persistent)

(c)          Incapacity

(d)          Failure to carry out reasonable instructions

(e)          Redundancy

(f)      The funding ceases or is reduced

(g)     Some other substantial reason

 

Except in circumstances justifying termination of your employment by the organisation you will be entitled to one month=s notice.

 

HOURS OF DUTY

 

You will be employed for Number of Hours in words (Number of Hours in numbers) hours per week.

 

SALARY

Your remuneration will be IR10.96 gross per hour and not negotiable.

 

ANNUAL LEAVE

 

You will be entitled to leave in accordance with the Organisation of Working Time Act 1997. 

 

SICK LEAVE

 

This post is not covered by any Sick Leave scheme, but where the contract exceeds 17 ½ hours per week, the Committee may, at it’s discretion, pay full salary in respect of minor indispositions not exceeding 7 days in a year or three days in any one instance.

 

ABSENCE

 

In the event of absence from work you are required to contact the Adult Education Organiser by 10.30 a.m. on the first day of absence.  The Vocational Education Committee reserves the right to have you examined by its own Medical Practitioner.

 

BASE

 

You will normally be required to work from Name of Centre designated as headquarters but you may be required, from time to time, to work from the premises of such subsidiary companies or organisations as the Vocational Education Committee or the Literacy Scheme may require.  You will be given as much notice of any such change of place of work as is reasonably practicable.

 

 PROFESSIONAL CONDUCT

 

The Vocational Education Committee requires a high standard of integrity from its entire staff.  In your capacity as a contract employee you must not accept gifts, rewards or inducements of any kind.

 

CONFIDENTIALITY

 

All information and knowledge acquired in the course of your official duties must be treated as confidential and must not be divulged to unauthorised persons or used for the purpose of gain or profit.

 

COPYRIGHT AND PATENT RIGHTS

 

The copyright in all material, documents or publications arising out of your work with them shall belong to the Vocational Education Committee and you shall, on request, do all things, which may be necessary to enable them to establish and protect its rights to such copyright.

 

TRAVEL ON COMMITTEE BUSINESS

 

In the event that your Motor Vehicle is used on the Scheme’s business either now or at any time in the future, you will be entitled to the agreed mileage rate in relation to this travel, which is paid in respect of all costs involved. You will be required to notify your Motor Insurance Company that the policy be extended so as to indemnify the Vocational Education Committee.

 

DISCIPLINARY / GRIEVANCE PROCEDURES

 

In the interest of fairness and justice, and to ensure the proper conduct of business, certain provisions to deal with matters of grievance and discipline are necessary, as follows:

 

Grievance Procedure

 

If you have any grievance, which you consider to be genuine in respect of any aspect of your employment, you have a right to a hearing by the Representative Group of the Literacy Scheme, as the circumstances warrant.  If you are unhappy with the outcome of the hearing you may appeal, in the first instance, to the Adult Education Board and following this to the Vocational Education Committee.  A fellow employee or union representative at this appeal hearing may accompany you.

 

In the event of the matter not being resolved internally the matter shall be referred through normal industrial relations procedures.

 

The procedure referred to above shall include reference to a Rights Commissioner, the Labour Relations Commission, the Labour Court, the Employment Appeals Tribunal or Equality Officer, as appropriate.

 

Disciplinary Procedures

 

Infringement of a term of this contract or of established rules can lead, depending on the gravity of the breach, to an informal or formal warning, suspension with or without pay. Ultimately, persistent breaches or inadequate work performance can lead, following warnings, to dismissal.

 

Certain grave breaches can lead, following consideration of all the circumstances by the

Vocational Education Committee, to summary dismissal or to suspension pending investigation.  In all dismissal cases, full investigation will be carried out, and you will have the right to put your case and be accompanied by another staff member or appropriate representative, and the right to appeal against a decision to more senior management.

 

In the event of your dismissal being confirmed and should you wish to challenge the dismissal then in accordance with normal procedures, the matter shall be referred to a Rights Commissioner, the Labour Court, the Labour Relations Commission, the Employment Appeals Tribunal or an Equality Officer as appropriate.
